House Bill 314

Description: The bill allows public offices to seek a court order to limit or deny public records requests where a requester submits multiple requests to the same office and the office has reason to believe the requests are intended to harass the office or disrupt the essential functions of the office.

The court may preemptively deny future requests from the requester if it finds it appropriate.

Public offices cannot seek this process if the requester is a journalist, a pro se litigant seeking records pertaining to litigation, or a state agency/staff of a public defender or government attorney.

The bill also allows public offices to contract out the handling of voluminous public records requests. The cost of contracting services can be included in the price of providing a copy of the public record.
