Senate Bill 122

Status: First hearing in Senate Local Government (March 5, 2025)

Description: The bill eliminates the authority for counties and townships to utilize zoning to regulate, in a platted subdivision or in an area consisting of 15 or more contiguous lots, the following:

  • Agriculture on lots of less than one acre;

  • Buildings or structures incidental to agricultural use on lots between one and five acres by setback building lines, height, and size; and

  • Dairy and poultry husbandry on lots between one and five acres where at least 35% of the lots are developed with at least one building, structure, or improvement that is subject to property taxation or is subject to manufactured/mobile home taxation.
