House Bill 42

Status: Introduced (February 3, 2025)

Description: The bill requires certain agencies to collect data concerning the citizenship or immigration status of persons who they come in contact with and to report that data.

For county purposes, the reported data must include the following.
 
Law Enforcement Agencies, must be reported to the Attorney General:
  • Number of people detained in the prior year who were citizens of the United States

  • Number of people detained in the prior year who were not citizens but were lawfully present

  • Number of people detained in the prior year who were unlawfully present

County Job and Family Services Departments, must be reported to the Ohio Department of Job and Family Services:
  • Total number of households for which all members were citizens or nationals of the US and total number of households for which at least one member was not a citizen or national but was lawfully present.

  • The total monetary value of benefits provided to households in which at least one member is not a citizen or national but is lawfully present.

  • Information about each assistance group receiving cash assistance to classify as one of four types and to include the total monetary value of benefits provided to assistance groups with at least one noncitizen who was lawfully present:

    • All members are citizens or nationals
    • At least one member of the assistance group is not a citizen or national but is lawfully present
    • For child-only assistance groups, all parents/guardians/custodians are citizens or nationals
    • For child-only assistance groups, at least one parent/guardian/custodian is not a citizen or national but is lawfully present
