Description: The bill requires ADAMHS Boards to inspect each recovery housing residence within its jurisdiction annually and provide a report no later than ten days after each inspection to the Department of Mental Health and Addiction Services (OMHAS). The board also must investigate any complaints that the Department receives concerning residences in its jurisdiction. Boards are permitted to contract for inspectors and investigators.
The bill also creates the certificate of need program for recovery housing, under which recovering housing providers must apply to OMHAS for a certificate of need in order to be allowed to undertake certain activities. There is an application fee equal to either $250 per bed or a separate method as determined by OMHAS.
The revenue from certificate of need applications shall be deposited into the Recovery Housing Residence Fund. This fund will be used to facilitate the inspections that the bill requires county ADAMHS boards conduct.
