Senate Bill 105

Status: 5th Hearing in Senate Community Revitalization Committee (April 9, 2024)

Description: The bill makes several changes to ADAMHS Board law, including requiring each board to conduct a fiscal audit of each community addiction services provider and each community mental health services provider at least annually, using guidelines from the Director of the Ohio Department of Mental Health and Addiction Services (OMHAS). The bill also includes provisions pertaining to ADAMHS board contracts, investigations into residential facilities, and data sharing and integration.

The bill also makes it a first-degree misdemeanor to operate recovery housing without certification or accreditation or to advertise any residence or building as recovery housing if it is not on the OMHAS registry of recovery housing or is not regulated by the Department of Rehabilitation and Correction.

Other Notes: Several other county officials have provided testimony in support of the bill, including Scioto County Commissioner Bryan Davis, Ashtabula County Commissioner Kathryn Whittington, and Lucas County Commissioner Pete Gerken (no written testimony). The Ohio Association of County Behavioral Health Authorities also provided proponent testimony.

In its As Introduced form, the bill included provisions pertaining to withdrawal from a joint-county district and the composition and appointment of ADAMHS Board members. These provisions were included in the state operating budget (House Bill 33) and were subsequently removed from the scope of SB 105.
